TERMS AND CONDITIONS
GENERAL TERMS
Except in the event of a written agreement, Asian Link Travel and its Client regardless of being particular or professional, agree to apply the General Selling Terms for all services Asian Link Travel provides to the Client. All services reserved for individual, or group tours are governed by the general selling terms. These General Selling Terms are valid irrespective of the form of contract, written or verbal between Asian Link Travel and its Client.
VALIDITY
All the tariffs provided to the Client are net and quoted in US dollars. Their validity is specified in the programs and/or proposals that are delivered to the Client. Asian Link Travel guarantees that the prices and/or tariffs being sent to the Client are valid at the time of working out and issuing the proposal and/or the invoice and that at any moment, these tariffs are subject to modification according to market hazards, monetary fluctuations, and fiscal reforms with or without prior notice.
Flight prices, however, can sometimes change, and this is beyond our control. Asian Link Travel reserves the right to adjust flight prices (upward or downward) if the cost to us is amended. These are usually the result of changes in fuel costs, official fees, or local taxes.
RESERVATIONS & CONFIRMATIONS
All reservations must be made directly in our office in Hanoi or our official trading agents outside Vietnam. Any confirmation of a reservation entails a deposit of 30 % (thirty percent) of the amount of the tour. The balance of the total amount of the tour file must be paid at least 15 days (fifteen days) before the date of starting the services to be provided to the client. If this article is not respected, Asian Link Travel reserves the right to cancel all reservations without refunding the deposit and the sums paid by the Client.
PAYMENT
In cases, the total price is below 10.000 USD
30% 1st deposit at confirmation
60% 2nd deposit 2 months before the arrival
10% Balance + eventual extra 2 weeks before the arrival
In cases, the total price exceeds 50.000 USD
30% 1st deposit at confirmation
30% 2nd deposit 2 months before the arrival
30% 3rd deposit 1 month before the arrival
10% Balance + eventual extra 2 weeks before the arrival
CANCELLATION
Count on the deposit amount and clients will pay the transaction fee
* Airfare is NOT refundable
* Cancellation within 21 days notice will be 100% refunded
* Cancellation with 14-20 days notice will be 75% refunded
* Cancellation with 7–13 days notice will be 50% refunded
* Cancellation with 6 days notice will be 0% refunded
* Cancellations due to subjective conditions such as typhoons, earthquake terrorism, or pandemics will be 100% refunded or discussed in a more beneficial way for guests
* When cancellation is a must for tourists, such as when family members pass away or the flight is canceled or delayed, we will base it on reality to help our guests lose as little as possible from our honesty
These deductions can be refunded by the insurance if you are insured, in the event of justified cancellation (especially disease, illness, accident, death, etc.)
If the balance of the tour is not received a month before the departure, Asian Link Travel reserves the right to cancel the reservation without indemnity.
If Asian Link Travel is under an obligation to cancel the departure for any reason, the participants will be fully refunded without the intention to claim any indemnities. All interrupted or shortened tours because of the participant for any cause, are not entitled to any reimbursement.
The vouchers must be issued by Asian Link Travel for all reservations. A copy of the itinerary and the vouchers must be delivered to the client before his/her arrival or the date of starting services.
FLIGHT CANCELLATION & DELAYS
Asian Link Travel takes no responsibility for travel arrangements as a result of flight cancelation, delay, or postponement for any reason. In such an event, the company will always try to assist as much as possible.
RESPONSIBILITIES
Asian Link Travel commits itself to trying its best to satisfy the client and provide the services being confirmed in the program. It is mutually agreed between the different parties that Asian Link Travel acts as an intermediary between airline companies, hotels, local transportation enterprises, and other suppliers of local services. Asian Link Travel would also not be liable to the Client in the event of lack or unsatisfactoriness of services provided by the third party and therefore indemnity or mistake or all other things, for any losses, injuries, damages, delays, changes of timetable and all other irregularities beyond its wish and/or suffered as a result of a behavior or of a shortcoming from a physical or moral person who supplies the services to the clients. All additional expenses due to these irregularities beyond our wishes such as delays, accidents, tiredness, natural disasters, and political events – non-exhausted list – are in the clients’ charge. The proposed programs, prices, and services are always valid at the time of printing out the programs and therefore can be modified at any time beyond our wish without prior notice. Asian Link Travel also reserves the right to modify the proposed program and services in the interest of the concerned parties. Participation in the tour implies complete acceptance by the clients (agents and/or tourists) on these terms.
COMPLAINTS AND CLAIMS
All complaints and disputes related to the services will be resolved as a priority by way of negotiation and mutual understanding. In the event of disagreement being persistent and amicably insolvable, the dispute will be submitted to the Vietnam International Arbitration Centre (VIAC) at the Chamber of Commerce and Industry of the Socialist Republic of Vietnam. All complaints must be submitted in writing within 30 days from the date of ending the services. Beyond this date, no partial or total refund can be considered.
ALTERNATION TO ITINERARIES
Itineraries and tours featured on our website and operated by the company are recommended as a suggestion only. Although it is unlikely that changes will be made to the travel plans of a tour, due to unforeseen circumstances, Asian Link Travel reserves the right to alter or change a travel itinerary at any time. Most changes made by the company are minor, and the company will endeavor to inform the client at the earliest possible time. If a major change is necessary, alternate travel arrangements will be sent to the client’s last known address, detailing the proposed changes. If changes to an itinerary are known before the date of departure, the client will have the choice:
- a) Accepting the proposed changes
- b) Taking another choice of tour with Asian Link Travel (of equal or lesser value)
- c) Cancelling the tour and receiving a refund from the deposit paid. Non-refundable deposits paid cannot be reimbursed.
For changes to travel itineraries after departure, the company reserves the right to alter or change travel plans without payment of compensation or a refund if it is in the client’s best interest to do so. Compensation, a full or partial refund will not be offered if the company is forced to cancel any tour due to major force (such as war, civil strife, political unrest, industrial dispute, terrorist activity, natural disaster, fire, adverse weather, and/or material or external circumstances before the company’s control).
SPECIAL REQUESTS
Clients with special requests, (e.g. non-smoking room, etc) should contact Asian Link Travel in writing at the time of booking. The company will aim to fulfill all reasonable requests, but special requests cannot be guaranteed and do not form part of the contract. Asian Link Travel will not be held liable for failing to comply with any special requests.
TERMINATION OF THE CONTRACT
Asian Link Travel reserves the right to end, cancel, or terminate the contract if the client demonstrates a behavior, manner, conduct, and/or action either during or before a tour that is likely to cause offense to other clients, endanger the property, well-being or safety and/or benefits of the other clients or the client himself/herself. In such instances, the client shall be subject to the company’s cancellation policy and the company will take no further liability or association with the client. If the conduct, behavior, and/or action of the client cause any damage to the accommodation where the client is staying or cause a delay or diversion to any form of transportation and/or the Tour, the client agrees to offer full indemnity to Asia Link Travel against any claim. These may include legal costs made against the company by or on behalf of any third party.
INSURANCE
Asian Link Travel strongly recommends that all clients find a comprehensive travel insurance policy that offers a high level of coverage for the full duration of the tour. Travel insurance is advised to cover personal injury, medical expenses, costs associated with repatriation to home country, compensation for loss of luggage, and expenses associated with the cancellation, postponement, or delay of a tour. The client acknowledges that in the event of injury or illness, all doctors’ fees, hospital costs, and repatriation expenses are the responsibility of the client and the company will in no way be responsible or liable for the refund of the tour cost. It is the client’s responsibility to ensure they are receiving an adequate level of insurance coverage and to read the full terms and conditions of their travel insurance before travel.
